1. Agreement to Terms

By accessing or using the Review Rescue platform ("Service") provided by RVQ INC ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

ReviewResQ is an AI-powered reputation management platform that provides automated review monitoring, AI-generated review responses, AI-powered voice calling and SMS messaging on behalf of your business, lead discovery and customer engagement, and analytics and reporting dashboards.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must be at least 18 years old and have the authority to bind the business you represent.

4. SMS and Voice Communications

Our Service includes AI-powered SMS and voice communications. By using these features, you acknowledge and agree to the following:

Your Consent to Receive Messages: When you opt in to SMS communications, you consent to receive automated text messages from RVQ INC (operating as Review Rescue) at the phone number you provide. Message frequency varies based on your account activity and settings. Message and data rates may apply. Consent is not required as a condition of purchasing any goods or services.

Opting Out: You can opt out at any time by replying STOP to any SMS message. After opting out, you will receive a confirmation message and no further messages will be sent. Reply HELP for assistance.

AI Disclosure: All AI-powered calls made by ReviewResQ on behalf of your business include a disclosure that the caller is an AI assistant. Calls may be recorded for quality assurance and compliance purposes.

TCPA Compliance: ReviewResQ enforces strict TCPA compliance, including Do-Not-Call list checks, calling hour restrictions (8 AM - 9 PM recipient local time), frequency limits, and consent verification. We maintain comprehensive compliance records as required by law.

5. AI-Generated Content Disclaimer

ReviewResQ uses artificial intelligence to generate review responses, communications, and analysis on behalf of your business. While we strive for accuracy and professionalism, AI-generated content may occasionally contain errors, inaccuracies, or phrasing that does not fully reflect your intended message.

Your Responsibility: You are solely responsible for reviewing and approving AI-generated content before it is published on your behalf. ReviewResQ provides tools for you to review, edit, and approve all AI-generated responses. By enabling automated responses, you acknowledge that you accept responsibility for the content posted on your business profiles.

No Guarantee of Outcomes: ReviewResQ does not guarantee specific business outcomes, review ratings, or customer engagement levels. AI-generated responses are tools to assist your reputation management — they do not constitute professional advice (legal, medical, financial, or otherwise).

Indemnification: You agree to indemnify and hold harmless RVQ INC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from AI-generated content published on your behalf, your use of the Service in violation of these Terms, or any third-party claims related to your business's use of ReviewResQ communications.

6. Acceptable Use

You agree not to use the Service to send spam, unsolicited messages, or communications that violate the TCPA, CAN-SPAM Act, or any applicable telecommunications regulations. You will not use the Service for any illegal purpose, to harass or deceive consumers, or to impersonate another person or entity.

7. Payment Terms

Paid features are billed on a monthly or annual basis as selected during signup. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. You are responsible for all applicable taxes.

8. Intellectual Property

The Service, including all software, designs, text, and other content, is owned by RVQ INC and protected by intellectual property laws. You retain ownership of your business data. You grant us a license to use your data solely to provide and improve the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RVQ INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease, and we will delete your data in accordance with our Privacy Policy. Compliance records may be retained as required by law.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of St. Johns County, Florida.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or notice on the Service. Continued use after changes constitutes acceptance.
